Welcome to New Evolution™ – Everything At Once.

These Terms of Service ("Terms", "Terms of Service", or "Agreement") govern your access to and use of the New Evolution website, online store, pages, features, products, services, customer account features, support services, and related digital experiences (collectively, the "Services").

In these Terms, "New Evolution," "we," "us," and "our" refer to New Evolution, the business operating the Services, and "you," "your," or "customer" refers to any person who accesses, browses, creates an account, places an order, or otherwise uses the Services.

Our brand is New Evolution™, with the brand identity "EVERYTHING AT ONCE."

By accessing, browsing, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and our other applicable policies, including our Privacy Policy, Return Policy, Shipping Policy, and any additional terms presented to you during a transaction.

Our online store primarily offers fashion and lifestyle products, including products and accessories for:

  • Women

  • Children

  • Fashion and apparel

  • Bags and accessories

  • Footwear

  • Selected lifestyle and other products that may be introduced through the Services

Our product range, categories, collections, brands, suppliers, availability, specifications, and product offerings may change over time.

We may add, remove, replace, modify, or discontinue products at any time.

We do not guarantee that every product displayed on the website will remain available.


SECTION 3 — PRODUCT INFORMATION AND DISPLAY

We make reasonable efforts to ensure that product descriptions, specifications, photographs, measurements, colors, prices, availability information, and other product information are accurate.

However, product appearance may vary depending on:

  • Your device;

  • Screen resolution;

  • Display settings;

  • Lighting conditions;

  • Photography conditions;

  • Manufacturing variations;

  • Material characteristics; or

  • Normal differences between individual products.

Colors displayed on your device may not exactly match the physical product.

If a material error in product information is discovered, we reserve the right to correct the information and, where appropriate, contact affected customers regarding an order.

All products are subject to availability.

We reserve the right to:

  • Limit quantities;

  • Refuse unusually large or suspicious orders;

  • Restrict purchases by geographic region;

  • Restrict purchases by customer or account;

  • Discontinue products;

  • Correct inventory errors;

  • Cancel orders affected by inventory or supplier issues; or

  • Modify product availability without prior notice.

Adding an item to a cart does not guarantee that the item will remain available until checkout or payment is completed.


SECTION 5 — ORDERS AND ACCEPTANCE

When you submit an order through the Services, you are making an offer to purchase the products included in that order.

An order confirmation or order acknowledgement does not necessarily mean that your order has been finally accepted.

We reserve the right to accept, reject, cancel, or limit an order for legitimate reasons, including:

If we cancel or materially modify an order after payment has been received, we will provide an appropriate refund for amounts actually paid for the affected order, subject to applicable law.

You are responsible for reviewing your order carefully before completing checkout.

Once an order has entered processing, cancellation may not always be possible.

Unless we expressly agree otherwise in writing, products purchased through the Services are intended for personal or household use.

You must not use the Services to purchase products for:

We may cancel or restrict orders that reasonably appear to involve unauthorized resale, fraud, automated purchasing, abuse of promotions, or other prohibited activity.

All prices displayed through the Services are subject to change.

The applicable product price is generally the price displayed at the time the order is submitted, subject to correction of obvious errors.

Prices may change due to:

  • Promotions;

  • Discounts;

  • Supplier costs;

  • Currency fluctuations;

  • Taxes;

  • Import or customs requirements;

  • Shipping costs;

  • Market conditions; or

  • Other business factors.

Unless expressly stated otherwise, displayed product prices may not include applicable taxes, duties, customs charges, import fees, shipping charges, or other charges that may be imposed by the destination country.

Where such charges are legally applicable, the customer may be responsible for them unless the applicable checkout terms expressly state otherwise.


SECTION 8 — PAYMENT AND BILLING

You agree to provide complete and accurate billing and payment information.

You represent that:

  1. You are authorized to use the payment method provided;

  2. The information supplied is accurate;

  3. The payment method belongs to you or you have lawful authorization to use it; and

  4. You authorize us and our authorized payment service providers to process the transaction.

Payments may be processed through independent third-party payment providers.

We do not control the internal systems, policies, security procedures, or processing decisions of independent payment providers.

If a payment is declined, reversed, disputed, or otherwise not successfully completed, we may cancel or suspend the related order.


SECTION 9 — TAXES, CUSTOMS, AND IMPORT CHARGES

New Evolution serves customers across multiple countries and regions.

Depending on the destination and applicable law, an order may be subject to:

  • Sales tax;

  • Goods and Services Tax (GST);

  • Value-added tax (VAT);

  • Customs duties;

  • Import duties;

  • Brokerage fees;

  • Clearance fees;

  • Local government charges; or

  • Other destination-country charges.

Where applicable law requires us to collect or remit taxes, those amounts may be included in the transaction.

Where taxes, duties, or charges are imposed by the destination country or its authorities after purchase, responsibility for those charges will depend on the applicable law and the shipping or tax terms associated with the order.

Customers are responsible for providing accurate shipping and customs information when requested.


SECTION 10 — SHIPPING AND DELIVERY

We offer shipping to supported locations according to the shipping options available at checkout.

Shipping times are estimates unless we expressly state that a particular delivery date or timeframe is guaranteed.

Delivery times may be affected by circumstances including:

  • Shipping carrier delays;

  • Customs processing;

  • Import inspections;

  • Weather;

  • Natural disasters;

  • Public holidays;

  • Address errors;

  • Incorrect contact information;

  • Transportation disruptions;

  • Government restrictions;

A shipping estimate does not constitute a guarantee of delivery on a specific date unless expressly stated.

Customers are responsible for providing an accurate and complete delivery address.

If an order cannot be delivered because of incorrect or incomplete information supplied by the customer, additional shipping charges or other consequences may apply where legally permitted.


SECTION 11 — ORDER TRACKING

Where tracking information is available, we may provide tracking details through the Services, customer account features, order communications, or other appropriate channels.

Tracking information is supplied by the relevant shipping or logistics provider and may not update continuously.

A tracking status may sometimes remain unchanged for a period of time while a shipment is moving between facilities, undergoing customs processing, or awaiting a carrier scan.

We cannot guarantee that third-party tracking information will always be complete, accurate, or immediately updated.


SECTION 12 — RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, and refunds are governed by our applicable Return Policy and any additional terms presented during the purchase process.

  • Used, worn, washed, altered, or damaged after delivery; or

  • Otherwise identified as non-returnable before purchase.

Nothing in these Terms is intended to remove or restrict any mandatory consumer rights that cannot lawfully be excluded.


SECTION 13 — REFUNDS

Where a refund is approved, the amount and method of refund will depend on the applicable Return Policy, payment method, transaction circumstances, and applicable law.

Refund processing may require reasonable processing time.

A refund may not necessarily appear immediately in a customer's account after we initiate it because the final posting time may depend on the customer's financial institution or payment provider.

Where permitted by law, shipping charges, customs charges, duties, handling charges, or other non-refundable charges may not be included in a refund unless otherwise stated.


SECTION 14 — INTELLECTUAL PROPERTY

The Services and their contents are protected by applicable intellectual-property laws.

Unless otherwise stated, New Evolution or its licensors own or control rights in materials associated with the Services, including:

  • New Evolution™ branding;

  • Logos;

  • Names;

  • Slogans;

  • Graphics;

  • Website design elements;

  • Original text;

  • Original photographs;

  • Product presentation materials;

  • Videos;

  • Audio;

  • Icons;

  • Layouts;

  • Original marketing materials;

  • Product reviews and other customer-generated materials to the extent legally owned or licensed by us; and

  • Other original content made available through the Services.

Our brand identity includes New Evolution™ and EVERYTHING AT ONCE.

You may access and use the Services for personal, lawful, non-commercial purposes.

Except where permitted by law or expressly authorized by us in writing, you must not:

  • Copy substantial portions of the Services;

  • Reproduce our original content for commercial use;

  • Republish our content;

  • Sell or redistribute our content;

  • Modify our protected materials;

  • Create derivative works from our protected materials;

  • Remove copyright, trademark, or proprietary notices;

  • Use our branding in a way that creates confusion about sponsorship or affiliation; or

  • Systematically extract or reproduce website content.

All rights not expressly granted remain reserved.


SECTION 15 — THIRD-PARTY SERVICES AND LINKS

The Services may use or provide access to third-party services, technologies, payment providers, shipping providers, analytics services, communication services, social-media services, applications, websites, or other external resources.

Third-party services are operated independently from New Evolution.

We do not guarantee the availability, accuracy, security, performance, or uninterrupted operation of third-party services.

If you access a third-party website or service through a link provided through our Services, you do so at your own discretion and risk.

Third-party services may have their own terms, privacy policies, and conditions, which you should review before using them.


SECTION 16 — CUSTOMER FEEDBACK, REVIEWS, AND SUBMISSIONS

If you voluntarily submit reviews, comments, photographs, suggestions, ideas, feedback, testimonials, designs, or other content to us ("Feedback"), you represent that:

  • You own the content or have the necessary rights to submit it;

  • Your submission does not violate another person's rights;

  • Your submission is not fraudulent or misleading;

  • Your submission does not contain unlawful material; and

  • Your submission does not contain malicious code or harmful software.

By submitting Feedback, you grant New Evolution a worldwide, non-exclusive, royalty-free, transferable and sublicensable license, to the extent permitted by law, to use, reproduce, adapt, publish, display, distribute, translate, and otherwise use that Feedback for operating, improving, marketing, promoting, and developing the Services.

We are not required to publish, maintain, compensate you for, or respond to any Feedback.

We may remove or decline to publish Feedback that we reasonably believe is unlawful, abusive, defamatory, misleading, fraudulent, obscene, threatening, infringing, or otherwise inappropriate.


SECTION 17 — PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services to:

  1. Violate any applicable law or regulation;

  2. Commit fraud or facilitate fraudulent activity;

  3. Impersonate another person or organization;

  4. Submit false or misleading information;

  5. Attempt unauthorized access to accounts or systems;

  6. Interfere with the operation or security of the Services;

  7. Introduce viruses, malware, malicious code, or harmful software;

  8. Attempt to bypass security or access controls;

  9. Conduct unauthorized scraping, crawling, harvesting, or systematic data extraction;

  10. Collect personal information of other customers without authorization;

  11. Abuse promotions, discounts, referral programs, or other offers;

  12. Purchase products using stolen, unauthorized, or fraudulent payment information;

  13. Engage in activities that could reasonably harm New Evolution or its customers;

  14. Infringe intellectual-property rights;

  15. Upload unlawful, defamatory, threatening, abusive, obscene, or infringing material;

  16. Use automated systems to interfere with normal website operation;

  17. Attempt to overload, disrupt, or damage the Services; or

  18. Circumvent restrictions designed to protect the Services or customers.

We reserve the right to restrict, suspend, or terminate access where we reasonably believe that these Terms have been violated.


SECTION 18 — AUTOMATED ACCESS AND AI SYSTEMS

Automated systems, bots, crawlers, scripts, artificial-intelligence systems, agents, or other automated technologies must not access or interact with the Services in a manner that:

  • Violates these Terms;

  • Circumvents access controls;

  • Overloads or disrupts the Services;

  • Scrapes or systematically copies protected content without authorization;

  • Attempts to bypass security measures;

  • Misrepresents automated activity as human activity; or

  • Interferes with normal operation of the website.

Authorized search-engine crawling and other automated access expressly permitted by applicable technical standards or by us are not prohibited by this section.

We may take reasonable technical measures to restrict unauthorized automated access.


SECTION 19 — SUSPENSION AND TERMINATION

We may suspend or terminate your access to all or part of the Services where reasonably necessary, including where:

  • You violate these Terms;

  • You engage in fraudulent or abusive conduct;

  • Your activity creates a security or operational risk;

  • Your account is associated with unlawful activity;

  • Continued access could expose us or others to legal liability; or

  • We discontinue or materially change the Services.

Termination does not affect rights or obligations that accrued before termination.

Provisions that by their nature should continue after termination, including intellectual property, liability limitations, indemnification, governing law, and dispute-related provisions, will continue to apply.


SECTION 20 — DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis.

We do not guarantee that:

  • The Services will always be available;

  • The Services will be uninterrupted;

  • The Services will be completely error-free;

  • Product information will never contain errors;

  • Website content will always be current;

  • Third-party services will always function;

  • Delivery estimates will always be met; or

  • The Services will satisfy every customer's individual expectations.

We make reasonable efforts to operate the Services reliably, but we cannot guarantee uninterrupted or error-free operation.

Nothing in these Terms excludes or limits any warranty, consumer protection, or statutory right that cannot legally be excluded or limited under applicable law.


SECTION 21 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, New Evolution and its owners, officers, employees, contractors, affiliates, service providers, suppliers, licensors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services or products purchased through the Services.

This may include, where legally permitted:

  • Loss of profits;

  • Loss of revenue;

  • Loss of business opportunities;

  • Loss of data;

  • Business interruption;

  • Replacement costs; or

  • Other indirect losses.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from fraud, willful misconduct, or other circumstances where applicable law prohibits limitation.

Where liability may lawfully be limited, our total liability relating to a specific transaction will not exceed the amount actually paid by you for the product or service giving rise to the claim, unless applicable law requires otherwise.


SECTION 22 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless New Evolution and its owners, officers, employees, contractors, service providers, affiliates, and representatives from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from:

  1. Your violation of these Terms;

  2. Your unlawful use of the Services;

  3. Your violation of another person's rights;

  4. Fraudulent or unauthorized activity associated with your account; or

  5. Your breach of any representation made under these Terms.

This provision does not require you to indemnify us to the extent that doing so would be prohibited by applicable law.


SECTION 23 — FORCE MAJEURE

We will not be responsible for delay, interruption, or failure to perform obligations caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Natural disasters;

  • Severe weather;

  • Fire;

  • Flood;

  • Epidemics or pandemics;

  • War;

  • Terrorism;

  • Civil unrest;

  • Government action;

  • Regulatory restrictions;

  • Labor disruptions;

  • Transportation disruptions;

  • Customs delays;

  • Internet or telecommunications failures;

  • Cybersecurity incidents;

  • Power failures;

  • Supplier disruptions; or

  • Other events beyond our reasonable control.

Where reasonably possible, we will take commercially reasonable steps to minimize the impact of such events.


SECTION 24 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

The invalidity of one provision will not automatically invalidate the remainder of these Terms.


SECTION 25 — NO WAIVER

If we do not immediately enforce a right or provision under these Terms, that does not mean that we waive that right or provision.

Any waiver must be expressly made by us and will apply only to the specific circumstance for which it was given.


SECTION 26 — ENTIRE AGREEMENT

These Terms, together with the policies and terms expressly incorporated into them, constitute the agreement between you and New Evolution regarding your use of the Services.

These Terms replace prior versions of the Terms governing the same Services, except where a separate written agreement expressly provides otherwise.

If there is a conflict between these Terms and a specific transaction-specific term presented to you during checkout, the transaction-specific term will control for that transaction to the extent permitted by applicable law.


SECTION 27 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent where such consent is legally required.

We may assign or transfer our rights and obligations where permitted by applicable law, including in connection with a restructuring, sale, merger, acquisition, transfer of business assets, or similar transaction.


SECTION 28 — GOVERNING LAW AND JURISDICTION

These Terms will be governed by the applicable laws of India, subject to mandatory consumer-protection laws applicable to you.

Where permitted by law, disputes relating to these Terms or the Services may be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka, India.

Nothing in this section is intended to prevent a consumer from exercising any mandatory legal right to bring a claim in another jurisdiction where applicable law grants that right.


SECTION 29 — CHANGES TO THESE TERMS

We may update, modify, replace, or revise these Terms from time to time.

The most current version will be made available through the Services.

When changes are made, we may update the "Last Updated" date shown at the beginning of these Terms.

Where required by applicable law, we will provide notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

These Terms are intended to establish the general rules governing use of the New Evolution Services.

Nothing in these Terms is intended to:

  • Remove statutory consumer rights;

  • Exclude rights that cannot legally be excluded;

  • Misrepresent the identity of the business operating the Services;

  • Prevent customers from exercising rights available under applicable law; or

  • Override mandatory laws applicable to a customer's transaction.

Where applicable law provides a customer with greater rights than those described in these Terms, those mandatory rights will continue to apply.
